Schedule of Costs – 2019

In compliance with the provisions of article 11.1 of the CAMARB Arbitration Rules of 2017 and 2019, the Administrative fee, arbitrator fees and other expenses (“Cost Schedule”) are hereby established, in force since June 18, 2019.

Registration Fee

To request the institution of arbitration, the party must pay the Registration Fee, currently set at R$5.000,00 (five thousand reais).

Notes:

  1. The Administrative fees include the holding of hearings at CAMARB offices, with the supervision of the Proceedings Secretary. If hearings are held in other locations, the parties must bear and advance the costs of room rental, travel, tickets, accommodation and meals incurred by the Proceedings Secretary.
  2. If it is necessary for the CAMARB Secretariat to make copies or scan documents, the costs must be reimbursed by the parties.

Notes:

  1. If the arbitration is conducted by three or more arbitrators, the fees of each co-arbitrator shall be equal to the above reference amount. The
    fees due to the President of the Arbitral Tribunal shall be equal to the reference value, plus 15%.
  2. If the arbitration is conducted by a single arbitrator, the amount of fees will be equal to the reference value above plus 30%.
  3. According to the Cost Calculator, the maximum limit for arbitrators' fees is R$650.000,00 for co-arbitrators and R$747.500,00 for the Presiding Arbitrator. The appointed professionals may request the consent of the parties to apply different percentages, depending on the characteristics of the case.

Counterclaim

In the event of a counterclaim, the costs will be calculated considering the sum of the estimated values of the dispute, considering the main pleads and counterclaims.

Segregation

Under art. 11.5 of the Arbitration Rules (2019), one of the parties may, at its discretion, request the segregation of the estimated value of the dispute, so that each party will bear the administrative fee and arbitrator fees calculated exclusively based on their claims.

Emergency Arbitrator Procedure

To request the initiation of an Emergency Arbitrator procedure, pursuant to item 9.1 of Administrative Resolution No. 06/20 (“Resolution”), the Party must pay the costs at the time of filing the request in the following amounts:

  • Emergency Arbitrator Fees: R$40.000,00 (forty thousand reais)
  • Administrative fee: R$15.000,00 (fifteen thousand reais)
  • Advance on expenses: R$5.000,00 (five thousand reais)

If the Party intends to file an objection to the Emergency Arbitrator, the protocol for this must be accompanied by proof of payment of the Administrative Objection Fee in the amount of R$5.000,00 (five thousand reais), in accordance with item 9.3 of the Resolution.

The amount paid as the Administrative fee for the Emergency Arbitrator procedure will not be refundable under any circumstances, as per item 9.5 of the Resolution.

To help the parties better visualize and plan the expenses inherent to each procedure, CAMARB has developed a calculator that allows users to determine the estimated value of arbitration costs. Aiming at the convenience of its users and predictability of the amount to be collected, CAMARB adopts a system of costs based on pre-established amounts, which are based on the estimated economic content of the dispute.
