Administrative Resolution No. 02/19

REF: ARBITRATION TABLE OF EXPENSES (2019)

The President of CAMARB – Business Mediation and Arbitration Chamber – Brazil, vested on his duties set forth in the Bylaws, and whereas:

  1. that there has been no adjustment to CAMARB’s Arbitration Table of Expenses since 2010;
  2. that an analysis of the costs applied by the main arbitration chambers of the country, with national action, was carried out, through which it was identified the need to adjust the values applied by CAMARB;

III. that the CAMARB´s Board of Directors, in a meeting held on June 3, 2019, approved, under the terms of the Bylaws, a new Arbitration Table of Expenses (2019);

Resolves:

  1. the new Arbitration Table of Expenses (2019) will be applicable to all proceedings requested from the present date onwards, in accordance with the Rules and Bylaws of the institution;
  2. the Chamber’s Communication department and Secretariat shall arrange for the publication of the new Table of Expenses on the institution’s website on this date;

III. the amount of the Arbitration Registration Fee is, as of this date, increased to R$ 5,000.00 (five thousand Brazilian Reais) –

  1. once the Arbitral Tribunal is formed, or the Sole Arbitrator is chosen, the parties shall deposit the amount of the proceeding Administration Fee and of the arbitrators’ fees, as well as they shall pay in advance, for the proceeding expenses, the minimum amount of R$12,000.00 (twelve thousand Brazilian Reais), each party to the proceeding being responsible to deposit one-half of such amount, unless otherwise agreed by the parties.

Notes:

  1. If the arbitration is conducted by three or more arbitrators, the fees of each co-arbitrator shall be equal to the above reference value. The fees due to the President of the Tribunal shall be equal to the reference value plus 15%.
  2. If the arbitration is conducted by a sole arbitrator, the amount of fees shall be equal to the above reference value plus 30%.
  3. The Administration Fee includes the holding of hearings in the CAMARB offices, with the monitoring of the Secretary of the Proceeding. If hearings are held elsewhere, the parties shall bear and pay in advance the costs of room rental, transportation, travel, lodging, and meals incurred by the Secretary of Proceeding.
  4. In case the Secretariat of CAMARB is required to make copies or scanning of documents, the costs shall be paid in advance and reimbursed by the parties.
  5. In case of a counterclaim, the costs will be calculated taking into account the sum of the estimated values of the dispute, considering the main claims and counterclaims.
  6. According to the Arbitration Rules, a party may, at its sole discretion, request the segregation of the estimated value of the dispute, so that each party shall bear an Administration Fee and arbitrators’ fees calculated exclusively on the basis of its claims. In the event of absence of full payment of the respective costs by either party, the respective claims shall be excluded from the arbitral proceedings, without prejudice to being deducted upon a future request for arbitration.
