EXCEPTIONAL OPERATION OF CAMARB DUE TO THE COVID-19 PANDEMIC – CORONAVIRUS

The President of CAMARB – Business Mediation and Arbitration Chamber – Brazil, vested on his duties set forth in the Bylaws: WHEREAS the World Health Organization (WHO) declaration of the Covid-19 pandemic; and

WHEREAS the prophylaxis measures that have been recommended by international and domestic bodies, and

WHEREAS CAMARB is committed to the integrity of its employees and to the users of its services, including arbitrators, mediators and attorneys.

Resolves:

  1. The physical protocols for the conduct of arbitration, mediation and DRBs are suspended in all CAMARB offices, namely in São Paulo, Rio de Janeiro, Brasília, Belo Horizonte, Recife and Salvador.
  2. The CAMARB´s Secretariat will remain available for assistance by e-mail and by telephone, on business days, from 9 am to 6 pm.
  3. The protocols shall be performed only electronically, observing also what has been established in the Terms of Reference, or by the Arbitral Tribunal in each case.
  4. Documents attached to statements shall only be sent via e-mail, together with the respective statement. If the size of the files is more than 10MB, it is recommended that they be shared via link. The Secretariat in charge, in the mentioned working hours, will be available to create links exclusive for each proceeding, upon request of the parties or the Arbitral Tribunal.
  5. In the ongoing proceedings, it will be up to the parties involved, arbitrators and mediators, to decide on any suspension of the proceedings, hearings, meetings, change of schedule, or any other modification they deem necessary to meet the restrictions imposed by the COVID-19 pandemic.
  6. The request for commencement of new arbitration, mediation or DRB proceedings shall be made through the e-mail address camarb@camarb.com.br.
  7. Proceedings already requested, in which no Arbitral Tribunal is constituted, mediator or DRB panel appointed, shall be conducted electronically by the Secretariat in charge. In the cases where electronic conduction is not possible, the General Secretariat of the Chamber will analyze the case and may, if necessary, suspend the proceeding until CAMARB returns to normal operation.
  8. This Resolution will enter into force tomorrow, March 18, 2020 and will be effective until March 31, 2020, after which CAMARB will assess the need for maintenance and or adequacy of the measures provided therein.
