The JOTA Portal published an article by Renata Faria, Vice-President of CAMARB, about the growing number of public works projects financed with federal funds that are paralyzed, which is overburdening the Judiciary.
In this scenario, it is necessary to seek other methods of conflict resolution such as mediation, dispute boards, and arbitration, already provided for by the Law on Bidding and Administrative Contracts.
The Dispute Board, an extrajudicial mechanism aimed at preventing and resolving disputes, consists of a committee composed of specialized and independent professionals who closely monitor the execution of the contract to avoid these delays, reduce litigation costs, offer specialized and swift solutions, and enable the timely delivery of projects while preserving the relationship between the parties.
According to Renata Faria, "the wheel has already been invented" and is being fully utilized throughout the world with great effectiveness.
