Schedule of Costs – 2018
I Administrative fee
1.1 The Administrative fee will be due to CAMARB – Câmara de Mediação e Arbitragem Empresarial – Brasil for its services in administering the mediation procedure described in the Mediation Rules.
1.2 The amount of the Administrative fee will be defined in accordance with the estimated value of the conflict, which may be revised by the mediator(s), as per the following table:

1.2.1 When requesting the institution of the mediation procedure, the applicant or group of applicants shall deposit half of the amount of the Administrative fee. This deposit is non-refundable and, therefore, will not be refunded by CAMARB if the respondent does not respond to the request or refuses to participate in the mediation.
1.2.2 If the respondent does not respond to the request or refuses to participate in the mediation and the claimant or group of claimants initiates the arbitration proceedings before CAMARB, the amount deposited as the mediation administrative fee will be considered as the arbitration registration fee. (Revoked by the issuance of Administrative Resolution No. 11/20).
1.2.3 When expressing an opinion on the Mediation Request, as per item 3.6 of the Mediation Rules, the respondent or group of respondents shall be responsible for depositing half of the administrative fee. This deposit is non-refundable.
1.2.4 If the total amount of the administrative fee is paid by the claimant and respondent parties, the rule set out in item 1.2.2 above will not apply.
1.2.5 If it is not possible to estimate the value of the conflict, the Administrative fee will be R$7.000,00 (seven thousand reais).
II Mediator's Fees
2.1 The amount of the mediator(s)' fees shall be divided among all parties involved in the mediation, with the claimant or group of claimants bearing half of the amounts due and the respondent or group of respondents bearing the remainder, unless otherwise stipulated. The amount shall be deposited before the signing of the Mediation Agreement, in an account designated by CAMARB, and shall be held by it as escrow for future release to the mediator(s) or return to the parties, in accordance with the Rules and this Schedule of Costs.
2.2 The amount of the mediator(s)' fees will be defined in accordance with the estimated value of the conflict, which may be eventually reviewed by the mediator(s), as per the following table:

2.2.1 If it is not possible to estimate the value of the conflict, the mediator's hourly rate will be R$650,00 (six hundred and fifty reais).
2.3 In any event, the parties shall be responsible for paying the equivalent of 10 (ten) hours of the mediator's work. The amount corresponding to 05 (five) hours shall not be reimbursed. If all or part of the remaining 05 (five) hours are not used, the remaining balance shall be reimbursed to the parties.
2.4 If the mediation is not concluded within 10 (ten) hours, at the end of the period, the parties must deposit the amount equivalent to another 10 (ten) hours and so on until the mediation is concluded.
2.5 Hours worked by the mediator(s) will be counted as those used in conducting mediation sessions, jointly or separately. The mediator(s) will be responsible for monitoring the hours worked.
2.5.1 If the parties submit written statements or documents, the hours worked by the mediator(s) to read and analyze such documents will also be counted. The hours will be monitored by the mediator(s).
2.5.2 If the appointed mediator resides in a (any) municipality(ies) other than that in which the mediation sessions will be held, the hours used by the mediator(s) for their travel will also be counted.
III Other Expenses
3.1 Any other additional expenses that may be necessary, such as those related to mail, photocopies, long-distance calls, food, equipment rental and location for the hearing, fees and travel of experts, assistants, translators and mediators are not included in the Administrative fee, and the CAMARB Secretariat may request an advance from the parties to cover these expenses.
3.1.1 In locations where CAMARB does not have personnel and infrastructure that can satisfactorily receive the parties, any expenses must be borne by the parties.
