ONLINE MEDIATION IN CAMARB: BUSINESS CONTINUITY IN VIEW OF THE COVID-19 PANDEMIC

The President da CAMARB – Business Mediation and Arbitration Chamber – Brazil, vested on his duties set forth in the Bylaws, and:

WHEREAS the World Health Organization (WHO) declaration of the Covid-19 pandemic; and

WHEREAS the social distancing measures that have been recommended by international and domestic bodies, and

WHEREAS the potential number of disputes arising from the crisis caused by the pandemic and the mission of CAMARB of offering and promoting solutions for extrajudicial settlement of business disputes with agility and efficiency.

Resolves:

  1. CAMARB, for sixty (60) days from the publication of this Resolution, will administer mediation procedures, established in accordance with its Rules[1], in the online modality and with reduced costs.
  1. All communications of the procedure will be made by e-mail, eliminating the hard copies, and the meetings will take place on a digital platform, the choice of which will be at the convenience of the parties and the mediator.
  1. The request for mediation (Attachment 01) shall be sent to the e-mail address camarb@camarb.com.br, together with the respective attached documents, proof of payment of the administration fee applicable to the claimant and containing the e-mail address(es) for sending communication to the respondent(s), pursuant to item 3.6 of the Mediation Rules of CAMARB[2].
  1. A reduction of twenty percent (20%) of the costs shown in the Table of Costs and Expenses[3] (Anexo 02) will apply to this modality of mediation, including the administration fee and the mediator’s fees.
  1. The parties shall pay the non-refundable amount equivalent to five (5) hours of work of the mediator.
  1. If the mediation is not concluded within five (5) hours, at the end of such period the parties shall deposit an amount equivalent to an additional five (5) hours and so on until the mediation is concluded.
  1. The other rules contained in the CAMARB Table of Mediation Costs and Expenses remain unchanged.
  1. This Resolution may be amended by act of the President of CAMARB.

[2] 3.6 The CAMARB´s Secretariat will send to the respondent, at the address informed by the claimant, the Request for Mediation, as well as a copy of these Rules and the list of the names included on its List of Mediators, in order to, within fifteen (15) days from its receipt, express its opinion on the request, as well as make the non-refundable deposit of its part of the administration fee.
