Free Mediation Program for Companies Affected by the Climate Crisis in Rio Grande do Sul

With the aim of promoting agile and effective solutions for the extrajudicial resolution of conflicts in the service of the resumption of economic activity in Rio Grande do Sul (RS), the Chamber of Business Mediation and Arbitration – Brazil (CAMARB), CAMERS (Arbitration and Mediation Chamber of CIERGS) and CAF (Arbitration Chamber of Federasul) are proud to make the Free Mediation Program available to companies in Rio Grande do Sul, from all sectors of the economy.

Mediation is a consensual means of dispute management, conducted by a mediator, an impartial third party without decision-making power, who, using specific techniques, assists the parties and encourages them to identify or develop mutually beneficial solutions to end disputes and litigation in a consensual manner.

Regulated by Law No. 13.140/2015, mediation is nationally and internationally recognized for the benefits it provides to those involved, including in the face of natural disasters, with speed and protagonism of the parties, for the joint construction of sustainable solutions that prioritize the maintenance of commercial relations.

Consequences of the Climate Crisis for Companies

The climate crisis in RS caused material, financial and operational losses to companies in the region, directly affecting their ability to fulfill contracts and commitments with local partners, from other states and even abroad.

One of the predictable results of this reality is the emergence of a series of business disputes, which, if not resolved, could make it difficult to resume activities and, more broadly, the state's economy.

Relying on the credibility, structures of the three Chambers and a body of highly experienced and qualified volunteer mediators, we offer a safe and collaborative environment so that companies can resolve their conflicts in a fair and efficient manner.

Who can participate

Companies of all sizes and sectors impacted by the climate crisis in RS are eligible to participate in this program*.
Business disputes of any nature may be submitted to mediation, except labor and consumer relations disputes.

* Limited to 3 (three) mediations per company (CNPJ), with no limit on the amount in dispute

Lawyers

For the mediation process, it is not mandatory for the parties to be assisted by a lawyer. The Free Mediation Program includes the review of agreements to be drawn up by volunteer lawyers appointed by CAMARB who will only act when neither party is accompanied by their own lawyers.

It is important to highlight that, if one of the parties is assisted by a lawyer, it will be essential that the other party is also accompanied by a lawyer freely appointed by them.

How to Apply

To register and enjoy the benefits of free mediation, the company must follow these steps:

Fill out the Registration Form: access the registration form available here and provide the requested information and documents about the company and the nature of the conflict.

Wait for Contact: After analyzing the application and accepting the invitation by the requested party, the team will contact you to schedule a Mediation session.

The mediation will be conducted by one of the volunteer mediators registered in the program, in accordance with the rules set out in CAMARB Mediation Rules, as far as is compatible with the special rules of this Program described herein and the Mediation Law.

 The mediators who will act in each procedure may be chosen by the parties from the list of volunteers or by drawing lots. There will be a rotation among the professionals in order to ensure efficiency in conducting the mediations, favoring, whenever possible, the indication of mediators based in the State of Rio Grande do Sul.

Mediations, when requested by the parties and whenever possible, may take place in person using the CAMERS and CAF rooms in Porto Alegre/RS.

If the opposing party does not accept mediation, or if the parties do not reach an agreement at the end of the procedure, they may still take the case to the Judiciary for contentious proceedings or, if they prefer, to arbitration, by drawing up an arbitration agreement, if there is no arbitration clause already included in the contract that regulates the relationship between the parties.

For further information on the arbitration procedure, CAMARB, CAMERS and CAF will be available, also guiding the parties to seek the support of the National Council of Mediation and Arbitration Institutions – CONIMA.

Program duration

Given its emergency and free nature, the Program will initially last for 6 (six) months, and may be extended for the same period with possible adjustments, if the results achieved in this first stage prove satisfactory.
